PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our services ("Dispute") shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the state where our principal offices are located, or remotely by mutual agreement.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Exceptions: Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Opt-out: You may opt out of this arbitration provision by sending written notice to legal@federaldebthelp.com within 30 days of first accepting these Terms. Your notice must include your name, address, phone number, and a clear statement that you wish to opt out.
YOU AND FEDERAL DEBT HELP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, the entire arbitration provision shall be void.
These Terms shall be governed by and construed in accordance with the laws of the State of [YOUR STATE], without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in [YOUR COUNTY], [YOUR STATE].
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any modifications constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.
